Il convient de noter qu&rsquo;un avis d&rsquo;inaptitude, \u00e0 lui seul, ne suffit pas \u00e0 mettre un terme au contrat de travail.<\/p>\n<p>En principe, cet avis ne concerne que le poste occup\u00e9 par le salari\u00e9 et laisse la possibilit\u00e9 d&rsquo;une r\u00e9affectation \u00e0 un autre poste. Par d\u00e9faut, l&#8217;employeur est tenu \u00e0 une obligation de reclassement.<\/p>\n<p>Il est important de rappeler qu&rsquo;un avis d&rsquo;inaptitude ne peut \u00eatre \u00e9mis QUE par le m\u00e9decin du travail. Actuellement, cela n\u00e9cessite seulement une visite m\u00e9dicale, alors qu&rsquo;auparavant deux visites \u00e9taient requises avant 2017 et la loi Travail de 2016. Avant de rendre son jugement, le m\u00e9decin du travail doit proc\u00e9der \u00e0 une analyse du poste ainsi qu&rsquo;\u00e0 une \u00e9tude des conditions de travail au sein de l&rsquo;entreprise. Il doit ensuite \u00e9changer avec l&#8217;employeur et recevoir le salari\u00e9 afin de discuter des indications et\/ou propositions susceptibles d&rsquo;\u00eatre formul\u00e9es \u00e0 l&rsquo;attention de l&#8217;employeur.
