L&rsquo;entreprise lui reproche deux griefs : avoir pris des cong\u00e9s pay\u00e9s sans autorisation pr\u00e9alable de sa hi\u00e9rarchie, et avoir organis\u00e9 du t\u00e9l\u00e9travail depuis l&rsquo;\u00e9tranger sans accord de l&#8217;employeur.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00a0\u00bb4.27.5&Prime; _module_preset=\u00a0\u00bbdefault\u00a0\u00bb theme_builder_area=\u00a0\u00bbpost_content\u00a0\u00bb hover_enabled=\u00a0\u00bb0&Prime; sticky_enabled=\u00a0\u00bb0&Prime;]<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\"><strong>Ce que le Conseil a constat\u00e9 : <\/strong>Sur le premier grief, le Conseil rel\u00e8ve que le bulletin de salaire du mois d&rsquo;ao\u00fbt 2022, \u00e9tabli par Altran elle-m\u00eame, mentionne express\u00e9ment l&rsquo;octroi de deux jours de cong\u00e9s pay\u00e9s aux dates exactes vis\u00e9es par la lettre de licenciement. L&#8217;employeur avait donc valid\u00e9 les cong\u00e9s qu&rsquo;il reprochait ensuite \u00e0 la salari\u00e9e d&rsquo;avoir pris. En l&rsquo;absence de preuve mat\u00e9rielle, ce grief ne peut pas davantage \u00eatre retenu.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\"><strong>Sur le pr\u00e9avis :<\/strong> la salari\u00e9e ayant pos\u00e9 des cong\u00e9s pay\u00e9s pendant sa p\u00e9riode de pr\u00e9avis, celui-ci aurait d\u00fb \u00eatre prorog\u00e9 d&rsquo;un mois. Altran ne l&rsquo;a pas fait. Le Conseil accorde un compl\u00e9ment d&rsquo;indemnit\u00e9 compensatrice de pr\u00e9avis ainsi que les cong\u00e9s pay\u00e9s incidents correspondants.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\"><strong>Sur les demandes rejet\u00e9es :<\/strong> la salari\u00e9e r\u00e9clamait \u00e9galement une indemnit\u00e9 au titre d&rsquo;une augmentation de r\u00e9mun\u00e9ration qui lui aurait \u00e9t\u00e9 promise. Le Conseil constate qu&rsquo;aucun engagement clair, irr\u00e9vocable et portant sur un montant pr\u00e9cis n&rsquo;a \u00e9t\u00e9 pris par Altran. Cette demande est rejet\u00e9e, de m\u00eame que les demandes fond\u00e9es sur la r\u00e9sistance abusive et la perte de chance qui reposaient sur les m\u00eames fondements.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=\u00a0\u00bb1&Prime; sticky_enabled=\u00a0\u00bb0&Prime;]<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\"><strong>Total des condamnations : 14 956,20 EUR + int\u00e9r\u00eats l\u00e9gaux + astreinte.<\/strong><\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\"><strong>Ce que cette d\u00e9cision d\u00e9montre :<\/strong> Altran a licenci\u00e9 une salari\u00e9e pour des faits qu&rsquo;elle avait elle-m\u00eame autoris\u00e9s, sans apporter la moindre preuve mat\u00e9rielle du second grief invoqu\u00e9. Le Conseil a m\u00e9thodiquement d\u00e9truit chaque motif.
